 FTTH Bundle Restrictions

Taxes and Fees not included and are subject to change. Fiber to the Home (FTTH) Bundles are only available to Residential customers in communities served with FTTH. Unlimited calling/long distance is for typical domestic residential voice use only and may not be used for data purposes including dialup internet. If usage under this plan is not consistent with typical residential customer usage, at the Company's sole discretion, ATMC may offer the customer an alternative plan or suspend, restrict or cancel the customer's service without prior notice. Calls that are not consistent with typical residential voice use include but are not limited to: use for general business purposes, commercial facsimile, auto-dialing, resale, call centers and telemarketing. Additionally, usage not consistent with typical domestic residential voice usage occurs when, for a period of two consecutive months, a customer's average monthly minutes of use under a specific unlimited calling/long distance plan is more than twice the monthly average minutes of use of all other customers with the same unlimited calling/long distance plan. Customer must subscribe to ATMC Long Distance and a qualifying ATMC Go Blue Unlimited Bundle Plan. All rates are subject to change. Additional requirements and restrictions may apply. Customer lines associated with educational institutions, (colleges, universities, etc.) are not eligible for this plan. Go Blue Nationwide Unlimited plan usage includes calls within the continental United States, Alaska, Hawaii, Puerto Rico and the US Virgin Islands. Go Blue Carolinas Unlimited plan usage includes calls within North Carolina and South Carolina only. Multi-party conference calls, calls to 900 numbers, directory assistance, calling card, operator services, international calling and toll free calling and such calls are subject to additional charges. Broadband speeds listed are maximum attainable speeds. Actual speeds will vary. Bundle package required for all unlimited calling plans. Upon cancellation of any bundled service, regular charges will apply to remaining services. Bundles may not be combined with any other discount offers for the same services. Bundle customers (except those without Broadband) will receive their bill statement online via email and can view their statement at www.atmc.net through the myATMC link. A paper bill statement will not be sent. Payment may be rendered by all customary means provisioned by ATMC. Monthly $1 ebill discount is not available with "Go Blue" Bundles.

This ATMC Price Protect Guarantee Services Agreement (the "Agreement") sets forth the terms and conditions covering your purchase of a discounted bundle of eligible services, as described in the marketing materials and/or in other information you received, that includes a combination of ATMC services ("Services") including, but not limited to Local Telephone Service, Telephone Calling Features, Long Distance Calling Plans, Broadband High Speed Internet. The following Price Protect Guarantee Terms and Conditions for discounted bundles are a binding addition to ATMC Residential Services General Exchange Services Tariff.

INITIAL TERM - MONTHLY FEES. You will be entitled to receive a bundled package of local telephone service with unlimited long distance calling within North Carolina and South Carolina or throughout the United States, or a combination of those services with High Speed Internet (depending on the package and availability) at a discounted monthly rate for two full years beginning on the date the services have been provisioned. If you were already receiving these services, the time will begin on the date you elected to take advantage of the discounted bundled services offering. ATMC reserves the right to terminate the bundled services package and associated discounts due to a violation of this agreement or a violation of the terms and conditions governing any of the services contained within your bundled services package.

RATES, TERMS AND CONDITIONS FOR EACH SERVICE ARE PART OF THIS AGREEMENT. This agreement incorporates by reference all applicable agreements, tariffs, rates, terms and conditions set forth in any other document for each of the Services included in your bundled package. If any terms of this Agreement conflict with the terms or conditions of any of the foregoing agreements or documentation, ATMC will determine which document takes precedence.

COMPLETION OF TERM - MONTHLY FEES. Upon the completion of your twenty-four month term, your Price Protect Guarantee Services package will continue on a month-to-month basis until such time as you notify ATMC that you wish to terminate or change in any way all, or any, of the Price Protect Guarantee Services. At that time, rates for the remaining Services will be billed at the then current rates. ATMC reserves the right to terminate the Price Protection Guarantee Services agreement at any time, and may increase your monthly fee at the end of your initial term. Any such fee increase will be described in a notice posted on the Notices section of www.atmc.net.

TERMINATION OF SERVICE- You have the option to cancel or downgrade any or all of the discounted Services at any time. To cancel services, call 910.754.4311. However, cancelation of any or all Price Protect Guarantee discounted services prior to completion of the 24-month term will result in an Early Termination Fee and you agree that you are obligated to pay ATMC an early termination fee equal to $150 minus $15 for each completed three-month period in the then-current term during which you continued to receive the Services. Except as described below, the Early Termination Fee will not apply if you cancel any (or all) Services within 30 days after you elected to take advantage of the discounted services offering. To do this, you are required to notify ATMC of your intention during normal business hours during the 30 day Trial Period. You are responsible for all monthly fees at the package rate until the date of cancellation or downgrade.

This Agreement is subject to ATMC's business policies, practices and procedures, which can change without notice. Unless otherwise prohibited by law, we reserve the right to change rates, terms and conditions in this Agreement at any time by posting a notice on the Notices section of www.atmc.net 30 days before the billing period in which the changes would go into effect. If you choose to use your Services after that point, you are accepting the changes. If the changes have a material adverse effect on you, however, you can end the effected Service(s) without an early termination fee, by notifying ATMC within 60 days after we send notice of the change.

DOWNGRADE PENALTY. You are permitted to downgrade from your Price Protect Guarantee Services package to a different Price Protect Services package if you enter into a new 24-month term discounted services agreement for a new Price Protect Services package. You are also responsible for monthly fees at the package rate until the date of the cancellation or downgrade. To cancel Services, call ATMC customer service at 910.754.4311.

TAXES AND FEES. ATMC reserves the right to charge (and you agree to pay) all applicable taxes, surcharges and other fees. These taxes and fees may change during the term of this Agreement without prior notice to you.

OTHER TERMS AND CONDITIONS. To remain eligible for the discounted monthly fee throughout the Price Protect Guarantee 24-month term, you must continue to receive all of ATMC's then-current Price Protect Guarantee services. If any services are cancelled during the term early termination fees and ATMC's regular charges apply for any remaining Services.

When you placed your order, you confirmed that you are the account holder for ATMC services at your address and that you are at least 18 years old. You agree that ATMC is entitled to assume that all the information you are providing to us is accurate.
